This paper search to answer the following question: what is the TJCE’s positioning about housing for low-income families removed from Permanent Preservation Areas? The study is essential to investigate whether court decisions that prioritize the mandatory eviction of irregular dwellings for subsequent demolition imply harm to the social rights of removed people. This research has a qualitative approach, based on literature review and small-N dimension sample analysis It is concluded that, in the verified period, the TJCE prioritizes the right to an ecologically balanced environment over the right to housing.
