A HISTORICAL PERSPECTIVE

work examines, from a materialist point of view, above all that of K. Marx, how the rise of the bourgeoisie and the productive capitalist organization are linked to a particular way of seeing the law and the institutions within a specific historical context: the beginning of modernity. On the one hand, it is demonstrated, through a historical and bibliographical analysis, the legal-moral assumptions underlying the legitimization of bourgeois politics and, on the other, it is analyzed the effects arising from this legitimation for the formation of the legal-moral superstructure of modernity. It is intended to present an overview of this historical movement and its consequences.
